Same scenario can be applied to an overweight camper / truck and assured clear distance (failure to stop in the required distance because the vehicle was loaded past the limits of it's braking capability) and smashes a car. Chances are the driver of the RV will walk away while the driver / occupants of the car will suffer personal injury or death. It all comes down to adjudication in a court of law and who has the biggest wallet. |
