Yes and no. Being a retired safety and compliance officer for a large carrier, I will say the usually the truck driver isn't injured but he still faces disciplinary action by his company, law enforcement and likely loss of employment plus plus points on his or her license.

Same scenario can be applied to an overweight camper / truck and assured clear distance (failure to stop in the required distance because the vehicle was loaded past the limits of it's braking capability) and smashes a car.

Chances are the driver of the RV will walk away while the driver / occupants of the car will suffer personal injury or death.

It all comes down to adjudication in a court of law and who has the biggest wallet.
